Shari’a courts in the Gaza StripShari’a courts in the Gaza Strip play a critical role in the determination of matters related to family law, or personal status law, including marriage, divorce, child custody, maintenance payments and inheritance.  As such they play a major role on the assertion of family and women’s rights.  This report sets out the applicable personal status laws in Gaza before moving on to review the structure of the Shari’a courts in Gaza which interpret and adjudicate on those laws. The report highlights the key legal actors in the Shari’a court system, notes courtroom practices and observations and concludes with consideration of the attitudes of women in Gaza towards the Shari’a courts.
